Who we are

Drivie is made and maintained by Cyril Hendriks, trading as Namiddag, based in Belgium. You can reach us at info@getdrivie.com.

Drivie is an independent app for Homey. Homey is a trademark of Athom B.V.; Drivie is not affiliated with, endorsed by or sponsored by Athom B.V.

Who you are buying from

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

Paddle is therefore legally your seller: they handle the payment, the invoice, the VAT and the refund, under their own buyer terms. That is why your statement shows Paddle rather than Drivie.

What you get

Drivie Standard is free and stays free. Drivie Pro is a subscription that belongs to one Homey: every phone connected to that Homey, along with any paired Apple Watch or Wear OS watch, has access to it.

What Standard and Pro contain is on the pricing page. A subscription is never required to use the app.

Drivie is offered in the countries where Homey is sold. Outside those countries you may not be able to install the app, and Drivie Pro is not for sale.

Trial, price and renewal

Every subscription starts with a thirty-day trial during which nothing is charged. After that it renews automatically at the rate that applied when you ordered, until you cancel.

Prices are on the pricing page and are shown in your own currency. If we change a price, the new price applies only from a following period, and we tell you in advance.

Cancelling and refunds

You can cancel at any time in Paddle’s customer portal, reachable through “Manage subscription” in the Drivie companion’s settings on your Homey. How refunds work is set out in the refund policy, which forms part of these terms.

Updates and changes

The service is provided as is, without warranty of any kind. There is no right to updates, new features or support. A subscription applies to the app as it is at the time of purchase; features may change or disappear, and future features may be offered as a separate, paid purchase.

In Belgium and the rest of the European Economic Area such an exclusion is not permitted, and the same is true in many other countries. Where that applies to you, that mandatory protection remains in force. For a running subscription that means the updates needed to keep the service working as agreed.

Liability

We accept no liability whatsoever for any damage arising from the use of this app. Use of Drivie is entirely at your own risk.

In particular, we are not responsible for a Homey that is offline or unreachable, outages at Athom or in your internet connection, third-party devices and services, flows you set up yourself, or the effects of an operating system that holds back background tasks or notifications.

In Belgium and the rest of the European Economic Area a complete exclusion of liability is not permitted, and the same is true in many other countries. To the extent the law forbids that exclusion, our liability is limited to what you paid for Drivie Pro in the twelve months before the damage occurred, and liability for intent, gross negligence, death or personal injury is unaffected.

Never rely on the app as your only security, and always keep a second way to get in or to switch an alarm off.

If a provision does not hold

If any provision of these terms turns out to be void or unenforceable, the rest remains in full force and that provision is replaced by the closest lawful equivalent.

Governing law and disputes

Belgian law applies to these terms. As a consumer you keep the protection of the mandatory law of your own country, and you may always bring a dispute before the court where you live.

If we cannot resolve it together, consumers can also turn to the Belgian Consumer Mediation Service. For anything about payment, invoicing or a refund, address Paddle: they are the seller.

Changes to these terms

We may amend these terms, for instance when the law changes or a feature is added. Where an amendment affects you adversely, we tell you beforehand and you may cancel before it takes effect.
